eBay and Half.com Advertiser Terms and Conditions



These Advertiser Terms and Conditions are part of the Network Agreement and will govern your participation in all Programs for websites that are operated either by eBay Inc. or eBay International AG (together referred to as "eBay" or the "Advertiser"). An overview of the eBay Programs that are governed by these Terms and Conditions can be found in the registration and after you access your account. By registering to participate in one or more eBay Programs, you agree to these eBay Advertiser Terms and Conditions and the Program Details of the Programs you are signing up for in addition to the Network Agreement and the Code of Conduct. These Terms and Conditions are supplemented by Program Details for each eBay Program. Terms starting with capital letters or defined in the Network Agreement have the same meaning as in the Network Agreement.

  1. Special Rules for Promotional Content and Promotional Methods: Your Promotional Methods and your Promotional Content may feature as many Links to the eBay websites in whose Programs you have been accepted to as you like. The position, prominence and nature of Links will comply with any requirements specified in the eBay Partner Network Agreement, the Code of Conduct, these Terms and Conditions and the Program Details, but otherwise will be in your discretion. If the position, prominence or nature of Links does not comply with the mentioned requirements, you will not receive compensation. The Promotional Content and Promotional Methods you use as part of your participation in the eBay Programs must comply with the following requirements:
    1. Wording Guidelines: Your Promotional Content must comply with the eBay Wording Guidelines.
    2. Search Engine Optimization Guidelines: You shall ensure that your domain name, the title and description of your website and the metatags you use are relevant and that your website only appears in search engine's result when the content of your website relates to the search query. You shall refrain from using search engine optimization methods that are in breach of the guidelines or best practices published by the search engine.
    3. No sniping: You may not include Links in software or a service that automatically places bids on behalf of eBay members or makes purchases via Buy It Now on behalf of eBay members.
    4. No confusion: You shall not design your Promotional Methods in a way that, in eBay's sole discretion, creates a likelihood of confusion with the eBay website or emails sent out by eBay.
  2. Prohibited Promotional Methods and Promotional Methods requiring prior written approval:
    1. Prohibited Promotional Methods: You will not engage in, and will not receive compensation for Promotional Methods and behaviors that are expressly disallowed below:
      1. All eBay Programs disallow any traffic from Promotional Content or Links served by ad networks or any other agents if it is linked directly to an eBay domain. This includes, but is not limited to the use of pop-ups and pop-unders to display Promotional Content or Links. However, linking from these paid placements to a non-eBay domain is allowed as long as you do not immediately or automatically redirect the end user to the eBay sites and services.
      2. All eBay Programs disallow the placement of Promotional Content or Links in any paid search results from any search engine, including but not limited to Google.com, Yahoo.com or MSN.com, or the parallel domains for those properties, or from any of their content networks (such as Google AdSense, Yahoo! Publisher Network or MSN ContentAds), if it is linked directly to an eBay domain. However, linking from a paid search placement to a non-eBay domain is allowed as long as you do not immediately redirect the end user to the eBay sites and services. If you buy traffic to your sites through sponsored links, you must ensure that all campaigns have the domains found here added to their list of excluded sites.
      3. All eBay Programs disallow Promotional Content placed on an eBay website itself (for example, in your listings, your "About Me" page, your store or the eBay message boards).
      4. All eBay Programs disallow Promotional Content that promotes listings or behavior that are in breach of eBay's policies.
      5. All eBay Programs disallow redirecting end users from the eBay website to an Affiliate's website where one of the possible outcomes of this redirection is that the end user clicks back to the eBay website via a Link that places a cookie for the Affiliate.
    2. Promotional Methods requiring prior express written approval: You will only engage in the following Promotional Methods after you have applied for and received express written approval by ePN or eBay for this Promotional Method for a Program, otherwise you will not receive compensation. The use of the following Promotional Methods is subject to further requirements:
      1. E-mail, instant messaging, IRC channels or other electronic communications
      2. Downloadable software
      3. Incentive programs including vouchers coupons
      4. Charity
      5. Distribution of Promotional Content via distribution partners or ad networks
      6. Building your own Promotional Content by using eBay's API
      7. Holding in-person trainings and classes
  3. eBay Trademarks: You will not:
    1. Adopt or use any company name, trademark, trade name, brand, domain name, or URL (specifically, any term before the third "/" of your URL) that incorporates as part thereof any of eBay's domestic or international trademarks (including the translations and/or transliterations thereof) including, but not limited to, "eBay", "PayPal", "Half", "eBay auctions", "eBaymotors", "ebay motors", "eBay jewelry", "PayPalpayments", "paypal payments", "Halfitems", "Half items";
    2. Adopt or use any variations of any eBay company trademarks, including (but not limited to) "e-bay", "ebay.com", "www.ebay.com", "e.bay", "e bay", "www.ebay", "ww.ebay.com", "e-bay.com", "www,ebay.com", "e.bay", "wwwebay.com", "ebya", "eaby", "Pay-Pal", "Pay Pal", "Half.com", "Half com", "Half.ebay.com", "Half ebay com", "ebay half") as part of your company's name, trademark, brand, domain name, or URL (specifically, any term before the third "/" of your URL);
    3. Adopt or use any term that consists of a generic or descriptive word, followed by the terms BAY and/or PAL (for example, "JewelBay" or "Jewelry Bay", "GlassBay" or "Glass Bay", "WeBay", "HappyBay", "FeePal", "HeyPal", "MoneyPal"); or
    4. Display your company name or trademark in an uneven, staggered, multi-color format that dilutes the distinctiveness of the famous multi-color eBay logo.
  4. Qualifying Transactions:
    1. You will find more information about the Qualifying Transaction for eBay's Programs in the Program Details of each eBay Program.
    2. Exclusion from Qualifying Transactions: ePN will not count as a Qualifying Transaction, and you will not earn compensation for:
      1. Transactions where you or your Agent are the end user.
      2. Non bona-fide transactions as described in the Code of Conduct or any other transactions in connection with any activity that is in breach of the Agreement.
    3. Last Cookie Counts: A transaction that occurs after an end user has clicked on several Links (and thus, multiple cookies have been placed on his or her computer) will be counted as a Qualifying Transaction only for the Affiliate whose Link has been the last one clicked, and the cookie was placed, before the transaction occurs and the cookie has not been overwritten by another cookie that was placed by eBay's own promotional activities.
  5. Compensation: Compensation will be calculated per Qualifying Transaction or as a percentage of eBay's revenue generated by a Qualifying Transaction as defined in the Program Details (https://www.ebaypartnernetwork.com/PublisherReg?js=true&lang=en-US). Compensation may be calculated using a tiered payment structure. ePN has the right to change the Program Details with respect to Qualifying Transactions and compensation at its sole discretion with seven days' notice.
  6. No Guarantee:
    1. ePN makes no guarantee regarding the level of impressions or clicks that may generate Qualifying Transactions, the timing of delivery of such impressions and/or clicks, conversion events, or the amounts of any payments to be made to you under this Agreement. For example, your earnings per click may vary from month to month, depending on eBay’s revenue generated by the Qualifying Transactions.
    2. ePN reserves the right to use its sole discretion when determining instances of invalid click activity. You agree that we are not obliged to disclose details about the functioning of our fraud detection systems. Because ePN has a need to protect its proprietary detection system, ePN may be unable to provide Affiliates with all information about their account activity, including any web pages, users, or third-party services that may have been involved in fraudulent activities.
    3. In addition, for the avoidance of doubt, ePN does not guarantee the Program will be operable at all times or during any down time (i) caused by outages to any public Internet backbones, networks or servers, (ii) caused by any failures of Your equipment, systems or local access services, (iii) for previously scheduled maintenance or (iv) relating to events beyond eBay’s (or its subsidiaries’ or subcontractors’) control such as strikes, riots, insurrection, fires, floods, explosions, war, governmental action, labor conditions, earthquakes, natural disasters, or interruptions in Internet services to an area where eBay (or its wholly owned subsidiaries) or Your servers are located or co-located.
  7. Miscellaneous:
    1. ePN may amend these Advertiser Terms and Conditions and the supplemental Program Details by notifying you by posting the amended Terms and Conditions in your Network account or informing you by email. After seven days the revised Terms and Conditions and Program Details take effect and become fully enforceable. If you do not agree with the revised Terms and Conditions you will remove yourself from all eBay Programs through your account and remove and stop promoting any eBay Links. If the change affects only one Program and you are registered for that Program, eBay may also inform you with a message in your account or by email about changes to the Advertiser Terms and Conditions and Program Details for that specific Program.
    2. ePN also reserves the right to have special promotional campaigns introducing new Qualifying Transactions and compensation schemes by posting them on the ePN website or in your account.
    3. Program Details for each eBay Program may include further provisions that supplement these terms and conditions. In the event of a conflict between these Terms and Conditions and Program Details specific to an eBay Program, the terms of the Program Details will prevail in relation to that eBay Program.
    4. Always make sure to accurately declare in which eBay programs you participate. Failure to do so will constitute material breach of the Agreement.
